The Unified Patent Court Guide 2025 Published by Chambers & Partners

Jadek & Pensa contributes insights into Slovenia’s patent law in the Unified Patent Court framework.

We are pleased to announce that our firm has authored the Slovenia chapter of the Chambers Global Practice Guide – The Unified Patent Court Guide 2025, now available on the platform of Chambers & Partners. The guide was prepared by our experienced intellectual property team: Aleksandra Jemc Merc, Eva Gostiša, and Eva Milošič. 

The guide offers a comprehensive overview of the current patent law framework in Slovenia, with a particular focus on the country’s participation in the Unified Patent Court (UPC). It is intended for legal professionals, in-house counsel, patent holders, and international companies seeking to understand the legal environment for protecting and enforcing patents in Slovenia. 

Key highlights of the Slovenia Patent Law guide include: 

  • Structure and operation of the UPC Local Division in Ljubljana, including details on presiding judges and procedural rules. 
  • Slovenia’s role in the Patent Mediation and Arbitration Centre (PMAC) and its institutional setup. 
  • Comparison between UPC and national court procedures, fees, and accessibility for SMEs. 
  • Overview of Slovenia’s national litigation framework, and the transitional role of domestic courts. 
  • Anticipated future trends, including the rise of UPC caseloads and increased participation of smaller entities. 

While Slovenia has not yet seen active cases before the Local Division of the UPC in Ljubljana, the country’s central geographic position and legislative alignment with EU systems place it in a potentially strategic position for future cross-border patent enforcement.
